Terms of Service

1. Agreement to Terms

By accessing or using the Blueforce platform, website (blueforceprime.com), mobile application, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Blueforce reserves the right to update these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance of the revised Terms.

2. Eligibility

To use Blueforce, you must:

• Be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher
• Be capable of entering into a legally binding contract
• Not be a resident of any jurisdiction where cryptocurrency-related financial services are prohibited or restricted
• Successfully complete all required identity verification (KYC/AML) procedures as required by applicable law
• Not have been previously suspended or removed from the Service

Blueforce does not currently offer services to residents of jurisdictions where such services would require regulatory approval that Blueforce has not obtained. It is your responsibility to determine whether using the Service is lawful in your jurisdiction.

3. Description of Service

Blueforce provides a cryptocurrency-to-fiat payment card service that enables users to spend cryptocurrency holdings at merchants that accept major card networks. The Service includes:

• Cryptocurrency deposit and real-time conversion to fiat at the point of sale, facilitated by third-party liquidity providers
• A payment card (physical and/or virtual) issued through our licensed card-issuing partner(s), linked to your Blueforce account
• Apple Pay and Google Pay integration for contactless payments
• Cryptocurrency cashback rewards on qualifying purchases, as described within the Service
• Collectible card designs, limited editions, and artist collaborations

4. Regulatory Disclaimer

Blueforce is not a bank and does not hold a banking licence. Card issuance and related payment services are provided by our licensed card-issuing partner(s), who are regulated under applicable payment service regulations. Blueforce is not a licensed securities dealer, broker, or investment adviser. Cryptocurrency conversion at point of sale is facilitated by third-party liquidity and conversion providers. Blueforce acts as a technology intermediary.

Cryptocurrency regulations vary by jurisdiction and are subject to change. Changes in regulation may materially affect the availability, scope, or features of the Service in your jurisdiction. Blueforce cannot guarantee continued availability of the Service in any particular jurisdiction.

5. Account Registration & KYC

You must provide accurate, current, and complete information during registration and keep your account information updated at all times. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Blueforce complies with applicable anti-money laundering (AML) and know-your-customer (KYC) requirements, including the Thai Anti-Money Laundering Act B.E. 2542. Blueforce reserves the right to request additional verification, suspend your account, or terminate the Service at any time to comply with legal or regulatory obligations.

6. Fees & Charges

Blueforce may charge fees for certain transactions and services, including but not limited to: card issuance, monthly maintenance, ATM withdrawals, currency conversion, and cryptocurrency conversion spreads. Current fee schedules will be disclosed within the Service before any charge is applied and may be updated with reasonable prior notice. Cashback rewards and loyalty benefit rates are as described within the Service and may change at any time.

7. Cryptocurrency Risks

You acknowledge and accept that:

• Cryptocurrency is highly volatile. The value of your holdings may decrease significantly, including to zero
• Exchange rates at conversion are determined at the moment of transaction and may differ from rates displayed at other times
• Blockchain transactions are generally irreversible once confirmed
• Smart contract vulnerabilities, network congestion, and protocol changes may affect the Service
• Cryptocurrency regulations vary by jurisdiction and may change, potentially restricting or prohibiting your access to the Service

Blueforce is not responsible for losses arising from price fluctuations, blockchain network failures, or regulatory changes.

8. Prohibited Activities

You agree not to use the Service to:

• Conduct or facilitate any activity that is illegal under Thai law or the laws of your jurisdiction, including money laundering, terrorist financing, tax evasion, or fraud
• Provide false, misleading, or inaccurate information during registration or verification
• Attempt to circumvent security measures, access controls, or rate limits
• Use automated systems, bots, or scrapers to access the Service without written authorisation
• Engage in any activity that disrupts, damages, or impairs the Service or its underlying infrastructure
• Resell, sublicense, or otherwise transfer access to the Service

Violation of this section may result in immediate account suspension, termination, and referral to relevant law enforcement authorities.

9. Intellectual Property

All content, trademarks, logos, card designs, software, and other intellectual property associated with Blueforce are owned by Blueforce or licensed to Blueforce by third parties. You may not copy, modify, reproduce, distribute, or create derivative works from any Blueforce intellectual property without prior written permission.

Collectible card designs are licensed to you for personal, non-commercial display only. No ownership interest in any card design is transferred to you.

10. Termination & Suspension

We may suspend or terminate your account at any time, with or without notice, for: violation of these Terms, suspicious or fraudulent activity, failure to complete required verification, regulatory or legal requirements, or any other reason at our reasonable discretion.

Upon account termination, any remaining positive cryptocurrency balance will be made available for withdrawal to a verified external wallet within a commercially reasonable period, subject to applicable legal holds, fraud investigations, or regulatory requirements.

You may close your account at any time by contacting support@blueforceprime.com.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Blueforce and its directors, officers, employees, agents, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, cryptocurrency value, business opportunity, or goodwill
• Losses arising from third-party service failures, including card network outages or liquidity provider failures
• Losses due to cryptocurrency price movements or blockchain network failures

In any event, Blueforce's total aggregate liability for any claim arising from the Service shall not exceed the total fees paid by you to Blueforce during the twelve (12) months preceding the claim.

12. Dispute Resolution

Any dispute, controversy, or claim arising out of or in connection with these Terms, or any breach, termination, or invalidity thereof, shall be submitted to the exclusive jurisdiction of the competent courts of the Kingdom of Thailand.

Before initiating formal proceedings, you agree to first contact us at legal@blueforceprime.com to attempt informal resolution within 30 days.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, including the Civil and Commercial Code of Thailand, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
